The service
These terms govern your use of Outbid, operated by Future Version Limited (company number 11739018). By using Outbid, creating an account, submitting a project, creating or entering an arena, or placing a bid, you agree to them.
Outbid provides a flagship project leaderboard and user-created arenas. Approved projects are ranked primarily by bid amount within a particular arena. Outbid is a promotional and community competition service; a placement is not ownership of part of Outbid, a security, investment, token, guaranteed advertisement, endorsement, or promise of traffic, sales, or any other result.
Accounts and security
You must provide an accurate email address, keep your password and devices secure, and promptly report suspected compromise. You are responsible for activity through your account unless applicable law says otherwise. You may not access another person’s account or create accounts to evade moderation, payment, ranking, or usage restrictions.
You must be at least 13. If you are under the age required to enter a contract where you live, a parent or guardian must agree on your behalf. Business users confirm that they have authority to act for the project, company, club, or community they represent.
Bids, rankings, and payments
Each bid applies only to the named project and arena. Higher approved bids rank above lower approved bids; where bids tie, the earlier entry ranks higher. Rankings can change whenever another approved contender bids more. Leaderboards do not have a scheduled annual reset, so an eligible entry remains in play unless it is removed, rejected, suspended, or the service changes under these terms.
Checkout shows the real amount in US dollars before you commit. Each new bid or rebid is charged in full; it is not a top-up of an earlier payment. A paid bid purchases the resulting eligible placement at that moment—not a fixed final rank or guaranteed level of exposure—and another contender may later outbid it.
Once a real bid is successfully paid and accepted, it is final and non-refundable except where a refund is required by law or Future Version Limited expressly agrees otherwise. This does not limit statutory consumer rights that cannot lawfully be excluded. We may refuse, reverse, or investigate transactions affected by fraud, technical error, duplicate processing, chargeback, sanctions, unlawful activity, or an unsafe destination.
Community arenas
Account holders may create public, unlisted, or private arenas. Public arenas may appear in discovery. Unlisted arenas are accessible to anyone who receives the URL. Private arenas use a shared access code, which can be forwarded; neither mode should be used to store confidential or sensitive information.
Arena owners choose their arena’s description, visibility, and access code, and may moderate contenders after they enter. They must administer those controls fairly and lawfully, protect shared codes appropriately, and must not present themselves as employees or agents of Future Version Limited. An arena owner’s decision is not an endorsement by Outbid, and platform moderation may override it where reasonably necessary.
Your content and intellectual property
You retain the rights you already hold in project names, descriptions, icons, arena material, and other content you submit. You grant Future Version Limited a non-exclusive, worldwide licence to host, store, reproduce, display, adapt for technical delivery, moderate, and promote that content as needed to operate Outbid. This includes limited sublicensing to service providers solely so they can help operate the service.
You must have the right to submit the content and link to the destination. Outbid’s name, design, logo, software, and original materials belong to Future Version Limited or its licensors and may not be copied or distributed without permission.
User obligations
When using Outbid, you agree not to submit unlawful, abusive, threatening, deceptive, infringing, sexually exploitative, or unsafe content; impersonate others; manipulate bids, rankings, access controls, or moderation; spam or harass users; expose personal or sensitive information; introduce malicious code; gain unauthorised access; or exploit technical vulnerabilities.
You are responsible for claims caused by content you knowingly or recklessly submit without the required rights. To the extent permitted by law, you agree to reimburse Future Version Limited for reasonable direct losses and third-party claim costs caused by that breach after notice and a reasonable opportunity to respond. This does not make a consumer responsible for our negligence or anything that cannot lawfully be transferred.
Moderation and review
Paid contenders publish after payment confirmation and may then be removed by an arena owner or by Future Version Limited. We may review links and reports; reject, hide, edit, or remove listings; suspend arenas or accounts; restrict entry; or preserve evidence where reasonably needed for safety, law, rights complaints, fraud prevention, payment integrity, or service integrity. Urgent action may be taken before notice.
A report or rejection is not itself proof of a breach. If we take platform moderation action against you, you can ask for review through the contact page or by emailing team@outbid.ly. Include the relevant project or arena URL, account email, and why you believe the decision should change.
Service availability
We aim to keep Outbid available but do not guarantee uninterrupted or error-free service. We may maintain, update, change, pause, reset, or discontinue features. We will handle account records and content according to applicable law and the Privacy Policy.
Limitation of liability
To the fullest extent permitted by law, Outbid is provided without guarantees beyond those expressly set out in these terms, and Future Version Limited is not liable for indirect or consequential loss caused by ranking changes, service interruption, user content, unsafe third-party destinations, arena-owner decisions, or third-party services. Nothing excludes liability that cannot legally be excluded, including your statutory consumer rights.
Suspension and termination
We may suspend or terminate access where you materially breach these terms, create legal or security risk, misuse the service, manipulate the competition, or fail to pay an amount properly due. Where practical, we will explain the reason and any available remedy.
During suspension, sign-in, editing, bidding, arena access, or public display may be restricted. After a confirmed serious or repeated breach, content and arenas may be removed. Transaction, moderation, security, and audit history may remain as described in the Privacy Policy.
Changes to these terms
We may update these terms. The “Last updated” date will show when they changed. If a material change affects existing rights, we will take reasonable steps to provide notice.
Governing law and severability
These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, except where mandatory consumer law entitles you to bring a claim elsewhere. If any part is found unenforceable, the remaining provisions continue in effect.
Other legal terms
These terms, the Privacy Policy, and any feature-specific terms form the entire agreement about your use of Outbid and replace earlier statements on the same subject. A delay in enforcement is not a waiver. Neither party is responsible for delay caused by events beyond reasonable control, except for duties that cannot lawfully be excluded.
You may not assign your account or these terms unless a supported feature expressly allows it. Future Version Limited may assign these terms to an associated company or successor, provided your rights are not materially reduced. Notices may be given through the service or the email address on your account. Except where expressly stated, no third party may enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
